Terms
Welcome to AS Media ("we," "our," or "us"). These Terms of Service ("Terms") govern your use of our real estate photography services and related offerings. By booking our services, you agree to be bound by these Terms.
Responsibility for Permissions:
You have obtained all necessary permissions to photograph the property, including from the property owner, tenant (if applicable), and property manager or HOA (for any shared/common areas). You confirm that all photography requested is authorized and that no area is being photographed without the proper approvals. You understand that these permissions must be in place prior to the scheduled appointment. You accept full responsibility for ensuring these permissions are in place, and you agree to release and hold harmless AS Media from any liability, claims, or disputes that may arise from unauthorized access or use of images.
Image Usage Release:
By booking this service, you grant AS Media the right to use the photos taken at the property for promotional purposes, including display in portfolios, websites, social media, marketing materials, and advertising.
Payment:
Clients may review all media in a watermarked format prior to payment. Once payment is received, the full-resolution, unwatermarked media will be made available for download.
Refunds:
Payment for services includes not only the final media products, but also the time, preparation, travel, and expertise required to complete the shoot. Once unwatermarked media has been delivered, all sales are final. No refunds will be issued after final delivery unless there is a clear failure to meet the agreed-upon service. If a client is dissatisfied due to a proven error on our part, we will make reasonable efforts to resolve the issue through re-editing, re-shooting, or a full or partial refund at our discretion.
Licensing and Usage Rights:
We retain the copyright to all images. Clients are granted a limited, non-exclusive, non-transferable license to use the images for marketing the listed property (MLS, brochures, websites, etc.). Images may not be resold or reused for other listings without written permission.
Liability:
We are not liable for any damages, loss of business, or legal issues resulting from the use or misuse of our photos. In the unlikely event of service failure or dissatisfaction, our liability is limited to the amount paid for the service in question.
Weather Policy:
If inclement weather affects the shoot (especially for outdoor or drone photos), we will reschedule at no additional charge. If the client insists on proceeding in poor weather, the results are accepted "as-is."
Media Disclaimers:
Floor Plans: All floor plans are provided for illustrative purposes only and are not guaranteed to be accurate or to scale. While we make every effort to ensure measurements and layouts are represented as clearly as possible, they may differ from the actual property. These visuals should not be used for construction, architectural planning, or precise measurement. Buyers, renters, and agents are responsible for independently verifying all information.
3D Virtual Tours / Matterport Scans: 3D virtual tours, including Matterport scans, are intended for general informational and marketing use only. While we aim to capture the property as accurately as possible, visual discrepancies, outdated elements, or image distortions may occur. These tours are not substitutes for in-person inspections and should not be solely relied upon when evaluating a property condition, dimensions, or features.
Governing Law:
These Terms are governed by the laws of the State of Hawaii. Any disputes arising under these Terms shall be resolved in the courts located in Hawaii.
Changes to Terms:
We reserve the right to update these Terms at any time. Continued use of our services after changes implies your acceptance of the new Terms.
